The Money Shot: Legally Stealing Music, Radiohead's Saving The World and Why There's No Innovation In The Music Industry...

    Today's headlines...

    Dropping Off The Beat (Forbes)
MS: "If you want to innovate in the music business today ... either you are illegal, in a gray zone or you don’t do it because you don’t get to do what you have to do to please the user," Leonhard said Thursday.

"Everything that’s cool is forbidden," he added, arguing, for instance, that the major labels oppose services that allow users to share music without permission, even though doing so could potentially expand the audience for the music.

How to save the record label (maybe) (CNN Money)
MS: "The kids can steal our music and I can still get paid," says Spank Rock. "God bless RCRD LBL, and God bless the Internet."

Radiohead: 'We won't play Glastonbury because of environmental issues' (NME)
MS: “What we’re trying to do now is only play in areas that have a public transport infrastructure in place,” he told The Sun. “So that rules out Glastonbury for this year. Maybe we can work out a plan for the future. They’re probably sick of the sight of us anyway.”

The Money Shot: EMI's More Focused on Money Than Music, Dylan & Jack White Collaborate with Hank I, and This Just In... Kids Are Downloading Music

    The latest news...

More teenagers ignoring CDs, report says (LA Times)
MS: Going to a store and buying a CD is no longer a rite of passage for many teenagers. But illegally downloading a song might be. Last year, 48% of teenagers did not buy a single CD, compared with 38% in 2006. And illegally downloading music continued to grow among teenagers, the report said.

Dylan calls in Jack White to write music for lost Hank lyrics (Prefix Mag)
MS: “[Dylan] came upon, somehow, twenty to twenty-five unfinished songs by Hank Williams -- just the lyrics, no music -- and he started to ask people if they would finish these songs. He did one, asked Willie Nelson to do one, asked me to do one, and I think Lucinda Williams and Alan Jackson are on it, too. I think it might come out this year. It's a cool record.”

EMI's owner derided for company shake-up (Guardian)
MS: "The power and the decision has sat with the A&R man, who is someone who gets up late in the day, listens to lots of music, goes to clubs, spends his time with artists and has a knack of knowing what would sell," Hands said. "What we are doing is taking the power away from the A&R guys and putting it with the suits - the guys who have to work out how to sell music."

The Money Shot: Radiohead's Big Ask, Apple Goes Number Two and Someone Finally Tells Maxim You Have To Listen To The CDs BEFORE You Review 'Em...

    Today's news...

Maxim apologizes for Black Crowes review (AP)
MS: The review in Maxim's March issue gives the Crowes' "Warpaint" a rating of two-and-a-half stars out of five. The band posted an exasperated statement on their Web site last week, saying the Maxim writer hadn't heard the entire album because advance copies weren't available. The Crowes' manager, Pete Angelus, said the magazine explained that its review was an "educated guess."

Radiohead back climate change initiative (NME)
MS: With reference to the importance of the project, Yorke says: “We will never wake from the nightmare of climate change unless our national governments and the European Union act. They are the only ones who can put the structures in place that will help us tackle climate change.

“That is why we are launching The Big Ask in 17 countries across Europe. By committing to annual cuts in our emissions at a national and European level we can play our part in tackling climate change, and set an example for the rest of world to follow.”

Apple beats Best Buy, Target in music sales; only behind Wal-Mart (Beta News)
MS: "The more interesting number is the 50 million customers, that's 50 million folks who have given Apple their credit card information and are buying stuff from them,"

The Money Shot: Bowie Ooh's & Ah's For ScarJo, Sowing Wild Oats with Greg Dulli & That Mobile Video Thing Might Catch On...

    More headlines...

Bootleg videotapes of concerts flourish (Columbus Dispatch)
MS: "We're dealing with thousands of people on a given night," said Blake Schilling, director of event services at Nationwide Arena. "We do the best to our ability to catch everyone. Obviously, when you're talking about thousands of people, it's pretty difficult."

David Bowie: 'Scarlett Johansson's performances are mystical' (NME)
MS: “The songs are great, really good Tom Waits stuff, and Scarlett's performances are mystical and twice cool. She creates a mood that could have been summoned by someone like Margery Latimer or Jeanette Winterson.”

However, the veteran artist played down his contributions to the record, saying: “I've seen the press on this and I suppose the record company wanted to spin my involvement a little more than it actually warrants. All I contribute are these oo's and ah's on a couple of tracks."

From down in the dark: The Gutter Twins step into the light (Drowned In Sound)
MS: "I’ll start by saying that I regret nothing and I’ll say that sowing my wild oats probably got in the way of productivity. But it was fun! I think what happened with the Whigs was that by the third record we had scattered to the four winds. When you’re a democracy, trying to get four guys in the same place for any length of time becomes more of a challenge and it actually began to hinder the creative and productive process. By the time we tried to mount it again it was just strange and unnatural. Something that had been like waking up in the morning and drinking a glass of water had become like algebra. That was when it was time for me to leave. We all left as friends and we still are. Then I worked on the first Twilight Record and laid low for a while, that’s when I bought my first bar. So I was running that and enjoying leading a structured life for the first time. For almost two years I was kind of afraid to write songs because writing songs would eventually mean I’d have to go on tour and I really didn’t want to."

The Money Shot: Hansard & Bono Are SMS BFFs, Louris & Olsen Making Record, & Prince's Not-So-Secret Hip Replacement

    The latest news...

Prince to have secret hip replacement (Music News.com)
MS: For months Prince, who always puts on the most energetic shows, has been complaining of pain every time he moves.

"He is totally crushed because he knows he will never be the same again."

Jayhawks Principals Ready New Album (Billboard)
MS: "I think it was one of the better experiences in my life," Louris says of those shows with Olson. "Just the fact that you had this close working relationship with somebody that went sour, and you kind of didn't talk for a number of years, and you had pretty much given it up. To then get a second chance here as friends and collaborators is pretty great. By touring, we got to know each other again, and to this day, now, we're just good of friends as we ever were."

Bono texts congratulations to Oscar-winner Hansard (NME)
MS: “What was really amazing for me was getting texts from family and friends, it was amazing beforehand, and then I got a text from Bono and I was like 'Ah, my God, that's just amazing.' For me it was just like getting a text off the King of the Tribe."

The Money Shot: The Hold Steady Party & Cut New Record, The Kinks = Living Dead? and EMI Isn't Talking To Art Brut...

    Today's headlines...

Davies Still Hopeful For Kinks Reunion (Billboard)
MS: "I can't get a band together just to play the old hits," Davies says. "They'd have to be able to do, like, 10% new material. I think that will be the determining factor in the long run."

The problem: Dave Davies seems to want no part of a reunion, having posted on his Web site that "it would be like a poor remake of 'Night of the Livin (sic) Dead' " and declaring that Ray has been doing "Karaoke Kinks shows since 1996," when the band last worked together. Ray's response: "He's getting well enough to shout at me. That's a good sign."

EMI release Art Brut single without telling band (NME)
MS: “It seems Art Brut have accidentally released a single. Yes, the rumours are true. But how could this happen, you may ask? Why were we not informed?

“Well, my friends, pick up any thread of incompetence and it will usually lead you to a record company. That's right, it seems EMI have decided to release 'Pump Up the Volume' without informing either the band or myself, making any kind of widescale promotion rather difficult.”

The New Hold Steady Album: Stay Positive (Pitchfork)
MS: Let's assume alcohol is involved. Maybe parties, too

The Money Shot:: U2, Foo Fighters and Le Tigre Getting New Stuff Together...

    The latest headlines...

U2 Hits The Studio In Dublin (Billboard)
MS: "We're going to try and break new sonic ground and deliver a masterpiece," Lanois tells Billboard.com. "The sleeves are rolled up. Bono is all charged up with a lyrical angle."

As previously reported, U2, Eno and Lanois have spent time working on new material on three prior occasions in France and Morocco, and Lanois confirms the results are prolific.

"There's so much material," he says, referring to speculation that the sessions could yield two new albums. "When you get Eno and I and those guys in the room, before lunch there's like eight things."

Foos Using Soundcheck To Work On New Songs
    (Billboard)
MS: "Well, we're gonna need a break," he says. "It's fun making the music; it's when you have to go out and promote it that it's work. So we're gonna be in a weird place -- we were on this last record, too. It's like, 'We just got done touring, but we're ready to record. What do we do?' You can't record it and leave it in a vault 'cause it'll get leaked, and it feels weird to just sit and wait arbitrarily for six months. We'll probably find ourselves in the same position again, excited to record but knowing that you've got a year of touring at the end of it."

Le Tigre Members Tour Behind New Project
    (Billboard)
MS: For now, the two artists only have a handful of new songs written, which will be tested on the road and released online as singles on their MySpace profile. "We've talked a lot about what we're going to do in terms of putting out new music and whether or not it makes sense for us to make a record or just put out singles," she says. "Right now I think we're just going to leak two tracks."

The Money Shot:: Sonic Youth For Sale (Kinda), Stephen Malkmus Wants The Music To Be The Star & Jay Farrar's Place In The Holy Trinity of Alt-Country

    More headlines...

Farrar and away (San Diego City Beat)
MS: But these criticisms don’t, in any way, mean that Farrar doesn’t belong in the alt-country Holy Trinity. His songs can take you to places that neither Adams nor Tweedy dare to venture. Farrar may not be as immediate or polished, but he’s a repeat-listen guy. Each time you hear a track, something else grabs your attention and, before you know it, you’re spending hours on iTunes scouring for every song he’s ever written.

Stephen Malkmus: trashed but talkative in London town (Drowned In Sound)
MS: There was this guy, I think he was in The Godfathers or something, in Mojo in a sidebar, and he was saying: “I want stars on stage. If the band looks like the roadies then they’ve lost the point and it’s completely horrible.” But 90 per cent of the time the band is boys, and I don’t want to sleep with them, so I don’t need them to dress up so much for me, you know? I want some image, some coolness and some decent clothes - I don’t want a complete slob up there - but I don’t need a star up there. I want the music to be the star. You’re dressing up for the girls, really. Music is not made by true stars. It’s made by the little people like Joy Division or something - they were the little guys who came up and made the big music. The Smiths, too - the little underdogs. They made the people’s music. They became stars afterwards, but they weren’t stars. They got elevated by the people. Their music made them the stars. I hate that attitude - it’s a sort of British attitude about it. Suede tried to have that attitude, too: “We need more glamour and more stars.” You become a star because you are. Go to Hollywood if you want to do that.

Painting that adorned classic album to be sold (The Independent)
MS: The painting that illustrated one of the most famous album covers in pop history is to be sold at auction. Sonic Youth's Daydream Nation scarcely troubled the charts when it was released in 1988 but has since been recognised as a rock masterpiece, regularly featuring in best album lists.

Later this month, fans of Eighties nostalgia will also have the chance to buy the art that gave the record one of the classiest covers ever produced.

The photo-painting, Kerze (Candle), is the work of avant-garde German artist Gerhard Richter. The original canvas will be put up for sale at Sotheby's in London next week and is likely to sell for several times its catalogue price of £2.5m.

MS: No. 24 - Nine Inch Nails - No '90s alterna-kid worth his or her Doc Martens was without the industrial band's patch on their backpack. NIN mastermind Trent Reznor co-designed the logo, inspired by the Talking Heads' 'Remain in Light' album sleeve.

    The 50 Greatest Guitarists... Ever!
    (Gigwise)
MS: 23. Kurt Cobain of Nirvana – As a three piece, Nirvana managed to consistently serve up a life-affirming, abrasive noise. At the core of this was Kurt Cobain – his tortured emotionally wrought vocals perfectly complementing his tense, deft and brilliant guitar work. A true legend.

The Money Shot: Small is the New Big, "Ruby" Got Screwed, and The Stones Tell Winehouse "Don't Do Drugs" (WTF?)

    More new headlines...

Rolling Stones tell young bands not to take drugs (NME)
MS: Sir Mick Jagger and Keith Richards were at the premiere in Berlin of Martin Scorcese’s documentary on their band, called 'Shine A Light', when they made the warning. Jagger said: “When we were experimenting with drugs, little was known about the effects. In our time, there were no rehab centres. Anyway, I did not know about them.”

The singer explained his feelings about Amy Winehouse, who guested with the legends onstage at the Isle Of Wight festival last year.

He said: “I'm worried she might die if she goes down the road that she has taken.”

Ricky Wilson: 'Everyone knows 'Ruby' is the best single'
    (NME)
MS: The singer told BBC 6Music: “Everyone knows 'Ruby' is the best single, if you are gonna whittle them down to five, you'd think 'Ruby' would be in there wouldn't you?”

The five tracks that were chosen are by Hoosiers, Mika, Take That, Leona Lewis and Mark Ronson.

The frontman explained: “They've all got their merits, but I am just a bit annoyed.”

    The itty bitty video (Boston.com)
MS: It's an era of shrinking budgets and exploding technology, a time when once-dominant MTV has morphed into reality-show central and the Internet has turned the entire planet into content providers. Size matters when cellphones are viewing screens and labels are staring down bankruptcy and a grass-roots, interactive culture is burgeoning in the music marketplace.

Small, for so many reasons, is the new big.

    Twelve Million Songs

Today, Musical Justice will cross another milestone by hitting 800,000 total listener hours (TLH) since we opened the doors in 2000. So I guess someone out there has been checking us out, eh? Doing a little math, at 15 songs per hour, that's 12 million times that an MJ listener has heard one of the songs on our playlists. If I only had a nickel for each of them... ;)

Anyway, congrats to me and thanks to every one of those listeners. Keep listening and tell all your friends so that we can hit a million TLH before the end of 2008!

    R.I.P, No Depression

It's a sad day... One of the magazines that most influenced the music you hear on Musical Justice is calling it quits after thirteen years. I think I started picking them up at the newsstand with Issue #3 (Steve Earle) and was a permanent subscriber by Issue #10 (Whiskeytown) in 1997. I never missed an issue after that.

When I launched Musical Justice in January 2000, the original name was Alt-Twang and the focus was heavily alt-country. I used to read that thing from cover to cover to get the lead on a new band. Over the years, as bands like Wilco strayed from alt-country and bands like the Jayhawks & Whiskeytown faded away, both the magazine and the renamed Musical Justice evolved into something broader. But neither of us forgot the organic roots music that put us on this path.

No Depression will carry on in reduced form online here. You can read their announcement there, but please also give them some support.

A little over a year ago, we nearly lost WOXY. Now it's No Depression on the ropes. And of course, Musical Justice was almost done in by the royalties batttle. Hard times for quality music these days...

The Money Shot: Bob Mould's Not 23 or Drunk or Up for Husker Du Reunion, DBT Not So Into Southern Rock Bands, Boston Not So Into Huckabee...

    Today's headlines...

Drive-By Truckers carry the torch for rock and roll (Idaho Stateman)
MS: We're certainly a rock and roll band, and we are undeniably Southern as s--t, but our influences and the things that led us to that place had as much in common with X and the Clash, and the Replacements, as it did Lynyrd Skynyrd and certainly more so than any of the other Southern rock bands. Because I'm really not a huge fan of that genre. That was one of the themes of the record, that kind of gets overlooked a little bit.

All things to all men (Guardian)
MS: "I can't recreate what people think they saw. I'm not 23, drunk and cranked up and angry. I'm not that person any more. The intensity of those records, I just can't do it. Heat with Grant and Greg [Norton, Hüsker bassist], yeah, that's all there, but it would be like a joke. It would not be becoming. It would do more damage than good to what the band stands for. And ..." He laughs. "I don't wanna be in the same room as those guys."

Rocker Tells Huckabee to Lay Off Song (AP)
MS: "Boston has never endorsed a political candidate, and will all due respect, would not start by endorsing a candidate who is the polar opposite of most everything Boston stands for," wrote Scholz, adding that he is supporting Democratic Sen. Barack Obama. "By using my song, and my band's name Boston, you have taken something of mine and used it to promote ideas to which I am opposed. In other words, I think I've been ripped off, dude!"

The Money Shot: Borders Goes Digital, The Moral Ambiguity of Kate Nash and Kids These Days...

    Today's amoral headlines...

“I only steal things that I think you should”: Looting the Bins with Kate Nash (Harp)
MS: “I went to a real crap restaurant recently with a friend. I’d been told that it was this great place, but it was just rank. There was this big picture of a butterfly hanging next to our table, and I grabbed it off the wall and put it in my bag when we left. No one saw it and I was quite pleased at how easily I got it. The restaurant was rubbish, but at least I got something good out of it. I’m kind of a moral thief in that way."

Teens Less Likely to Download Illegally When They Know the Laws, Microsoft Survey Finds (Microsoft)
MS: In general, teenagers regard illegal downloading over the Internet as less offensive than other forms of stealing. Less than half of the teens surveyed (48 percent) indicated punishment was appropriate for illegal downloading, while 90 percent indicated punishment was appropriate for stealing a bike.

New Borders Stores Embrace Digital Music (Billboard)
MS: The nation's No. 2 bookseller plans to open 14 of these stores this year as part of a plan to both close the gap and differentiate itself from industry-leader Barnes & Noble Inc, chief executive George Jones said in an interview.

"If you don't have something you do better than the other guys, then frankly the customer doesn't really need you," Jones said. "This is really intermingling the typical bricks and mortar with the Internet and digital worlds."

The Money Shot: Radiohead Remixes, Replacement Reissues & Horny Rock Chicks...

Make sure you download those Radiohead remixes!...

Into you like a train: Detroit slick chicks pick their horniest tunes (Metro Times)
    MS:
RACHEL NAGY (The Detroit Cobras): "Libidinous? Oh, hell, I was told this was going to be 'love songs'! You say someone picked Ted Nugent? Well, I can believe that. 'Stranglehold' is very sexy. And [Willie Dixon's] 'Spoonful' is a very sexy song. Oh, man, you got me over a barrel. You know, we Cobras don't deal with sex songs as much as we deal with the 'Gee Whiz' kind of stuff. And, of course, I'm not home right now so I can't flip through my records -- so I'm just trying to think. What songs do I listen to when I fuck? (laughs) Of course, for men, it's different. That's why Ted Nugent comes up. The guitar was basically invented for men to jack off on. Well, for me, James Brown's 'Please, Please, Please' is perfect for that kinda down-on-your-knees thing. And Etta James' 'Tough Lover' and 'You Know What I Mean.' Those are the ones I would go to. And here's a ... well, I don't know if it's shameful but it's kinda weird -- I like to listen to Squeeze when I fuck. I love Squeeze! That's my dirty sexy song secret! 'Goodbye, Girl' and all that stuff. My God, it's great. Do I ever listen to the Cobras when doing the deed? Oh, no, no, no! Other people do, though, and that's a huge compliment. But no, no, listening to my own stuff? That would really ruin it for me! (laughs) I don't like myself that much! My publicist told me this was about love. That's just like a man, y'know? They tell you and make you think it's all about love ... when it's really only all about sex."

Long-Awaited Replacements Reissues Due In April (Billboard)
MS: The Replacements' first three albums and an EP will be reissued in remastered, expanded form this spring, completing a long awaited upgrade of the seminal band's early work. "Sorry Ma, Forgot To Take Out the Trash," "Stink," "Hootenanny" and "Let It Be" will arrive April 22 via Rhino, Billboard.com can reveal.

Originally released on the band's hometown label, Twin/Tone, the albums were prepped for reissue by Replacements manager Peter Jesperson, with involvement from the surviving band members.

Radiohead remixes available for free (NME)
MS: California DJ/Producer AmpLive has released 'Radiohead Rainydayz Remixes' as a free download. The selection of remixed and reimagined Radiohead tracks from their recent album 'In Rainbows' features the likes of Del The Funky Homosapien and Chali2na rapping over the mixed-up tracks.

AmpLive has put together a website that contains the downloadable remixes with a message that reads, "It's not up to you. It's free."

The Money Shot: Police Shut Down Black Francis, Is There A Pavement Reunion In The Cards? & Costello, Nirvana Lead Mega-Grammy Snubs...

    Today's headlines...

Stephen Malkmus: 'Pavement reunion would be interesting' (NME)
MS: "We're on fine terms, we don't have any plans to do that [reform] yet,” explained Malkmus. “We haven't talked about sincerely doing that. I'm 1000 per-cent committed to the people I'm working with now. I would never cheat on them and go and do Pavement, it's not on the cards.”

However, he didn’t rule out the reunion in the long-term, saying: “But who knows? Maybe it would be a good thing to do, maybe it'll feel right one day. I don't really ever think about it, except when I do interviews."

The 7 Most Unforgivable Grammy Award Snubs of All Time (Cracked)
MS: Now, if this was 1970, "Smells Like Teen Spirt" Vs. "Layla" would be a pay-per-view-worthy battle royale of epic proportions. But it wasn't, it was 1992 and "Smells Like Teen Spirit" was the most important song of its day and "Layla" had morphed into a tender, acoustic ballad. Putting aside for a second that the song was over two decades old, the version of "Layla" that was nominated was about as far from rocking as you could get. Once stripped of it's memorable guitar riffs, boundless energy and devil horn-worthy awesomeness, this new, all growed-up "Layla" had no damn business being in the rock category to begin with.

Black Francis street gig halted by police (NME)
MS: Francis was performing at St Stephen’s Green in the city, running through a mixture of solo material and songs by his legendary band, Pixies, when police became worried about overcrowding.

They stepped in and escorted Francis away, leading some fans to believe he had been arrested. However, police were moving him on in an attempt to disperse the crowd.

The Money Shot: Being Indie Ain't All It's Cracked Up To Be, Neil Young Has Given Up & Mellencamp Gets McCain To Back Off 'Our Country'...

A mostly political set of headlines...

McCain Camp Stops Using Mellencamp Songs (AP)
MS: Publicist Bob Merlis said Mellencamp told him that the situation made him uncomfortable and he couldn't imagine McCain would want to be associated with him.

"You know, here's a guy running around saying, 'I'm a true conservative.'" Merlis told The Associated Press. "Well, if you're such a true conservative, why are you playing songs that have a very populist pro-labor message written by a guy who would find no argument if you characterized him as left of center?"

Neil Young: Music Can't Change World (AP)
MS: "I think that the time when music could change the world is past," he told reporters. "I think it would be very naive to think that in this day and age."

Young added: "I think the world today is a different place, and that it's time for science and physics and spirituality to make a difference in this world and to try to save the planet."

    Perfecting His Pitch (Washington Post)
MS:"I enjoy being grass-roots. I enjoy being an independent artist. But anybody who is an artist who tells you they'd rather have 50,000 fans versus 50 million is a liar," DeVaughn says.

The Money Shot: RIAA & House Go After College Downloads, Red: More a Business Than a Charity, & What's Going To Take The Place of a Mix Tape?

    The latest news...

Bono’s Red under fire for emphasizing the bottom line (Prefix)
MS: Though the donation margin for Red is less than other charities, what critics are missing is that it isn’t really a charity. People who give to nonprofit organizations aren’t suddenly going to quit and do their giving by buying a cell phone. The purpose of Red is to reach the multitude of people who give nothing to charity and give others an opportunity to have a little less guilt about that new iPod. Even though its margin of giving is less than that of other charities, Red has already pledged more to fight AIDS than the nations of Russia, China, Saudi Arabia, and Switzerland.

Rob Sheffield writes the book of mixtape love (San Francisco Guardian)
MS: How's this for a universal truth: if you've ever given a good goddamn about music and you've ever been touched by someone in your life (or wanted to be touched, as the case may be), you've surely sat yourself down and made a mixtape to put all of those feelings into 90 minutes or less. It's a rite of passage for any music freak who dares to live beyond the safe confines of his or her headphones; many of us revisit that breathless, nerve-racked experience over and over again, freezing our latest crushes in little plastic time capsules, hoping they'll build to something bigger. The messenger may have changed — we've gone from tape to disc and now maybe to the playlist — but the message remains the same: "I like you. Do you like me?"

House approves MPAA-backed college antipiracy rules (CNET)
MS: "Now that the data produced by the MPAA, the lead advocate for this provision, shows that illegal file-sharing by students using university servers is a very small part of the larger file-sharing issue, this provision is the moral equivalent of using a bazooka to kill a fly," said Barry Toiv, a spokesman for the Association of American Universities.

The Money Shot: White Stripes Get Sued, Feist Tops Shortlist, & Study Determines That Musicians Write About Drugs (DUH!)

    More headlines...

Study finds U.S. music awash in booze and drugs (Reuters)
MS: "It's not going to be feasible or even desirable to censor these messages," Primack said in a telephone interview. "Probably a more empowering approach is to teach kids to analyze and evaluate the messages for themselves."

White Stripes Sued for Sample Used Eight Years Ago (Pitchfork)
MS: Buried amid the furrows of the De Stijl LP and within the rainbows on the CD is a tune called "Jumble, Jumble", track number 11. And found among the less than two minutes of recorded sound on said track are 10 sampled seconds-- 10 seconds which may end up costing the Stripes $70,000.

According to a Canadian Press report, former Quebec radio host and current university lecturer Dominique Payette alleges the above-mentioned sample is taken from her radio show and was used without permission. She insists her privacy has been violated and is suing the band, Third Man Records, and BMG Music Publishing Canada for the above-mentioned amount. What's more, she's seeking an injunction that, if granted, would force the Stripes to remove De Stijl from stores.

Feist's 'The Reminder' Wins 2007 Shortlist Prize (Billboard)
MS: Feist's "The Reminder" (Cherry Tree/Interscope) has won the 2007 Shortlist Prize, which recognizes albums released between January and November 2007 that have yet to be certified gold by the Recording Industry Association of America for U.S. shipments of 500,000 units.

The Money Shot: Tom Waits for President?, Bright Eyes Shine For Obama, & Mellencamp to McCain: "Hands Off Our Country"

An all-political, post "Super Tuesday" edition...

Candidates know coolness is in the eye of the voter (Boston.com)
MS: "If coolness was the main factor, we'd be voting for the Tom Waits/Kanye West ticket."

Mellencamp Asks McCain to Stop Using Tunes (Rolling Stone)
MS: Uplifting heartland rock must have seemed like a smart pick, but there’s just one problem: Mellencamp is an ardent Democrat. And, until recently, he supported John Edwards – who had been playing “Our Country” and “Small Town” at his rallies. Mellencamp hasn’t yet made a public response, but his reps are quietly reaching out to McCain and asking him to stop playing his tunes.

Bright Eyes, M. Ward Rally for Obama (Pitchfork)
MS: This Thursday, February 7-- not long after the Super Tuesday dust has settled-- Bright Eyes and M. Ward will take to the stage at Omaha's Slowdown to voice their support for their candidate of choice: Senator Barack Obama. This is of course not the first time Bright Eyes' Conor Oberst has sung praises of Obama; the Saddle Creek songsmith previously rocked an Iowa caucus rally back in January.
