MS: "The lawsuits, however, are not working," according to the report by the California privacy group. "Today, downloading from P2P networks is more popular than ever, despite the widespread public awareness of lawsuits."

The report's conclusion: "Suing music fans is no answer to the P2P dilemma."


Belle and Sebastian Are Looking for a Few Good Ladies (Pitchfork)
MS: Earlier today, Murdoch posted an entry in his diary on the band's website, grumbling about a frosty summer in Glasgow and then spinning a (thinly-veiled, autobiographical?) yarn about a boy, two girls, and the superior summer they spent wasting away the hours playing music. Murdoch alludes to a set of songs written-- but never recorded-- by these characters, which he'd like to complete with the help of the two girls from his story, or, failing the discovery of some sort of tear in the continuum between fantasy and reality, two adequate stand-ins. And that, lassie, is where you come in.

So I don't know that it was stifling, but it was kind of like painting half of a picture and then giving it to somebody else to finish."

R.I.P, Hilly...

How ironic that the scene that he helped create added so much value to the neighborhood that he was eventually priced out. But without his vision, how different would today's music scene be? Would we even know about the Ramones, T-Heads, Blondie and Patti Smith without his venue to champion their music in the world's greatest city?

Hilly Kristal, CBGB Founder: R.I.P. (Harp)
MS: Kristal had operated the legendary venue since the mid ‘70s, eventually seeing it forced to close last year in the aftermath of a failed legal battle to save it. CBGB owed a massive back rent bill, and Kristal’s tireless efforts to have it preserved as a historical landmark ultimately fell on deaf ears—no pun intended. CBGB, of course, midwived the careers of Blondie, the Talking Heads, Television, the Ramones and scores others, many of whom—including the Bad Brains and the Dictators—performed at the club during its final days.


Rock of ages (San Diego Union-Tribune)
MS: Last year's Top 100 U.S. tours attracted a cumulative audience of 38 million. Aerosmith, which had 2006's 10th biggest grossing tour, brought in $58 million, $147 million less than Madonna's tour earned. The two youngest groups in the Top 10 were Bon Jovi, which was formed in 1983, and the Dave Matthews Band, which was formed in 1991.


When Good Music Happens To Bad Ads (MSNBC)
MS: Listening to Mould, of Husker Du and Sugar fame, should evoke memories of that guitarist you had a crush on in high school, or the concert where you were crammed up against the stage, singing along as loud as you could and still unable to hear your own voice. It should not make you think of potential investment vehicles.

Lou Reed Works With the Killers on New Track (Pitchfork)
MS: Pardon our incredulity. It's not that the Killers aren't awesome in their way, but "their way" is sort of the same thing Lou Reed's spent much of his career standing outside of. Also, don't bands generally wait until they have more than a couple albums before they drop a rarities comp? And wouldn't you think Lou Reed would maybe choose a band a little more road-tested (or with a bit more gravitas) than the Killers for a rare guest appearance? Perhaps Lou, like the rest of us, wishes he wrote "Mr. Brightside", too.

MS: Leslie sounds better than she did on Conan and all, and if you'd never heard her before last night you probably would've "ooh"ed" and "aah"ed at her voice, but seeing as you've sang along to "1234" countless times, it's really just a trip to see Ed Droste, Chris Bear/Taylor, Dan Rossen, Carl (and Christy!) Newman, Kevin Drew, and Nicole Atkins, alongside our dudes in the National and Feist's Reminder cover photographer (thin blonde to your right of Kevin Drew) -- all wearing white, with those crazy, sparkly colored bangles.

MS: “I love TV on the Radio’s production,” he said, referencing the critically acclaimed Brooklyn indie-rockers, “but man, at the end of the day, Keane and the Killers have bigger hooks.” Mr. West stops, considers, then laughs. “The last thing I need now in my quest to be cool is for somebody to think I dissed TV on the Radio.”

MS: My parents, when they heard the song ["Big Wheel"] for the first time were in my truck and I was driving them down the coast somewhere in Florida. They heard the album in my car, on my truck stereo while we, you know, just got a little picnic and drove up and down. And they had the lyrics in front of them. Digital music services try to nibble away at Apple (Yahoo/Reuters)
MS: Several digital music service providers -- including MTV's Urge, Rhapsody, Verizon Wireless, Wal-Mart and Yahoo Music -- have unveiled new forays designed to shine light on their struggling services in the shadow of Apple's still-dominant iTunes.

While no individual effort is likely to dislodge Apple from its No. 1 position, all are clearly efforts to chip away at its commanding lead. According to data from NPD Group, Apple controls 73.7 percent of the retail digital-music market, with more than 3 billion tracks sold since it went live. iTunes is also the third-largest music retailer of any kind, surpassed only by Best Buy and Wal-Mart.

MS: Midway through the set stage cameras panned the crowd, which included a scantily clad young woman, about whom Corgan commented "There's something about a girl who's willing to take her top off so quickly."


Raconteurs Spill A Few New Album Beans (Pitchfork)
MS: "Ok, the time is right. The teurs have a lot of new songs in the works people, the writing and structure of them has dissipated and reinvigorated and many times over since we came home from our last shows."


Sloan Is Back (Toronto Star)
MS: "It'd be hard to see how much money you could make just by putting out singles because we depend on radio play. In order to rely on someone to work your song on radio, you really have to be selling an album."

MS: "These shows will be the last Morrissey will do for the foreseeable future," a statement from the singer's publicist said. "With that in mind, all of the venues have been specifically chosen, as they are small and intimate where Morrissey can see the eyes of everyone in the audience and those in attendance can be in the thick of it."


The Cure Postpone Fall Tour Until Spring (Pitchfork)
MS: "We want to remodel/rework the live show for North America," they wrote by way of excuse on their website. "Change things around, incorporate new songs... and we need time and focus to do this."


Beth Ditto strips off at the Carling Weekend: Reading Festival (NME)
MS: The set ended with a mass singalong to 'Standing In The Way Of Control', during which Ditto peeled off her dress, prompting mass cheering from the crowd. The singer then bent over with her backside facing the audience, gave the 'single finger' gesture between her legs, then left the stage to rapturous cheering with her band.


Truckers Make Local Stops (Birmingham News)
MS: "Mike Cooley and I have 22 years in now this month," Hood says. "Our band always works as a democracy, but at the same time, there's a certain amount of - for lack of a better word - seniority in the relationship he and I have. That sort of leads the way for what the direction the band is going to be moving in, the direction the two of us go in, and we were kind of moving in a different one."

MS: "In England we have a lot of B-sides that people in America would never know about because we don't have singles here," Flowers tells Billboard.com. Morrissey Rewards Diehards, Quashes Smiths Reunion (Billboard)
MS: Morrissey's publicist has confirmed the artist refused a $75 million offer to tour under the Smiths name in 2008 and/or 2009, with the only mandate being that Smiths guitarist Johnny Marr would be part of the band. The Smiths also declined a multi-million dollar offer to perform in recent years at the Coachella Valley Music & Arts Festival in Indio, Calif.


Self- discovery fuels Mark Olson's 'Salvation Blues' (STL Today)
MS: "I was just thinking about this: It was about different levels of responsibility. I'd just gotten married, I'd bought a house and I really liked that. With the Jayhawks, I'd been renting, we had a tour manager, and the only real responsibility in my life boiled down to writing five songs every three years and playing the acoustic guitar. MS: Wal-Mart announces the launch of "DRM-free" MP3 music downloads, now available online at http://www.walmart.com. At only 94 cents per track and $9.22 per album, the new MP3 digital format delivers value, convenience and the ability for customers to play music on nearly any device, including iPod(R), iPhone(R) and Zune(TM) portable media players. Wal-Mart is one of the first major retailers to offer MP3 digital tracks with music content from major record labels such as Universal and EMI Music.

Chris Frantz, Tina Weymouth, and Jerry Harrison are all alive and well. The problem is, they all seem to kind of hate David Byrne. They did, however, all get together to play at their 2002 induction into the Rock and Roll Hall of Fame. A new album isn't necessarily what we're after with The Heads; their rip-roaring live show is.

MS: I look at myself as a bit of a pioneer about that too. In the mid-90s, that's when I went indie. We started making indie records out of necessity, and we were trying to figure out how to deal with it. And we've been doing it now since the mid-90s. And I think that our contemporaries are catching up to us. I mean, everybody I know, if they're not indie, they're suffering. You can be Rod Stewart, and be Clive Davis' dog, and have a career at the expense of your artistic soul. I have nothing but negative things to say about that, because I respect him as a singer, and I hate what he does. He sold his soul. And I take that personally.

How The CD Was Developed (BBC News)
MS: In 1977 Philips began to take the development of a new audio format much more seriously. A new name for the product was discussed and names considered included Mini Rack, MiniDisc, and Compact Rack. The team settled on Compact Disc because it was felt it would remind people of the success of the Compact Cassette.

MS: It sounds stupid, but I was listening to Bread on the plane ride over here, though I'm not a particularly big Bread fan [laughs]. But I happened to be listening to the Bread song "Guitar Man", which is exactly what the album is about. Bread, this really successful band, but they are celebrating this mythical guitar man roaming from town to town-- and then one day no one gives a shit but he's still out there doing it. It's sort of like "Lodi" by Credence Clearwater Revival. Any artist, even if you're wildly successful, if you're not incredibly arrogant you can imagine yourself in that position where one day people don't give a shit about you anymore. I mean, sooner or later, people don't give a shit about you, and if you equate your whole life and your whole personality and everything that is special to you with your artistic powers, it gets very crushing to imagine the loss of those powers.

Top 10 Alt-Country Greats Not Recorded by Uncle Tupelo (Stylus)
MS: 10. Marah – Kids in Philly (2000)

Much preferable for smoothing your alt-country transition than the better-known A Ghost Is Boring, these Philly kids amp up Steve Earle’s songwriting with the crowded space of a great E Street Bruce tune. Two joyous keg riots start the proceedings, “Faraway You” and “Point Breeze,” which shoot off harmonicas like fireworks in the street to “do battle down the boulevard.”

Dave Bielanko’s scrunched-up Bruce affectation and the band’s propensity for do-do-do's and sha-la-la's sets off the “barbecue for everyone” that Van Morrison’s too artsy for. They shuffle ridiculous metaphors in “My Heart is the Bum on the Street” and forever cement their second encore with the marching “Round Eye Blues,” which makes excellently vertical use of castanets, accordion and a little “Be my little baby.” The best sidewalk-and-shore juke band since, what, Southside Johnny?

MS: Fresh off their latest tour, the Violent Femmes are headed for a surprise gig in federal court. Bassist Brian Ritchie sued lead vocalist Gordon Gano yesterday (Aug. 15), saying he was deprived of credit for some of the group's songs and a proper accounting of its earnings.
